WHAT IS WORKERS' COMPENSATION
Workers Compensation is No-Fault Insurance: This means that if you have been injured at work in Massachusetts, you are entitled to certain benefits regardless of carelessness. Most injuries occur during slips and falls, exposure to certain chemicals (or even COVID) and personal injuries, however there are times when workers can have an injury and not know that it is work related. These are often called repetitive trauma injuries which occurred from the overuse of a body part or repetitive movement.
WHAT TYPES OF BENEFITS CAN AN INJURED WORKER GET?
There are two main benefits that an injured workers is entitled to when they are injured on the job: lost wages and medical benefits. However, other benefits can include scarring and permanent loss of function and disfigurements, survivors' and dependents' benefits. This can all be confusing and calculating the correct amounts can be overwhelming, therefore seeking help from an attorney is vital for your case.
WHAT ARE PERSONAL INJURY CASES
Personal injury cases, unlike worker’ compensation claims, are negligence base. This means that in personal injury cases an individual seeks damages from an individual/organization who caused some time of harm due to their negligence. These types of cases are generally unexpected and serious injuries that can cause havoc in a person’s life. In addition, there is physical, emotional, and financial harm that has been caused by someone else’s recklessness. In these situations, the injured parties are entitled to compensation. However, it is important to seek an attorney who is experience and can seek what you’re entitled to in damages.
